Terms of Service

These Terms of Service (“Terms”) govern your access to and use of WebMax Realtors, operated by WebMax Labs LLC (“WebMax,” “we,” “us”). By creating an account, signing in, or using any site we host, you agree to these Terms. If you do not agree, do not use the service.

The service

WebMax Realtors hosts a public website for each real estate agent on a *.webmaxrealtors.com subdomain or a connected custom domain, and provides a CRM to manage listings, leads, contacts, and conversations. Features include lead capture forms, QR-enabled listing pages, an AI assistant, email notifications, and data export.

Accounts and eligibility

You must be at least 18 years old and able to form a binding contract to use WebMax Realtors. REALTOR® accounts sign in through Google. You are responsible for activity that happens under your account and for keeping your sign-in credentials secure. Notify us promptly if you suspect unauthorized use of your account.

Your content and data

You keep ownership of everything you bring to or create on the platform: your listings, branding, written content, leads, contacts, and conversations (“Your Content”). You grant WebMax a limited, non-exclusive license to host, store, process, and display Your Content solely to operate and provide the service. You are responsible for Your Content and for making sure it is lawful and does not infringe anyone’s rights.

Leads and contacts

When you collect leads and contacts through your site, you are responsible for handling that information lawfully, including obtaining any required consent and honoring do-not-contact and unsubscribe requests. You will comply with the real estate advertising rules, fair housing laws, and communications laws that apply to how you contact people.

Acceptable use

You agree not to:

• Use the service for anything illegal or fraudulent.
• Publish content that is infringing, defamatory, or discriminatory.
• Send spam or unsolicited bulk messages.
• Attempt to access another tenant’s data or breach platform security.
• Interfere with or disrupt the service.
• Resell or sublicense the service without our written permission.
• Misrepresent your identity or licensing status.

Portability and your right to leave

You can export your leads, contacts, and conversations as CSV files or a full data bundle at any time from the CRM. WebMax Realtors is built so you are never locked in: you register and own your custom domain, and on cancellation we provide a final data export plus a static copy of your site. Owning your domain, your leads, and your content is a core promise of the product.

Fees and cancellation

Fees, if any, are described when you sign up or as otherwise agreed in writing. WebMax Realtors is offered month-to-month, and you may cancel at any time. On cancellation, your public site is taken down and we provide your data export and static bundle. Except where required by law, fees already paid are non-refundable.

AI features

The AI assistant generates text automatically and can make mistakes. Its responses are not professional, legal, or financial advice. Review AI-generated content before you send or rely on it. You are responsible for any message you choose to send.

Service availability

We work to keep the service available and reliable, but we provide it on an “as is” and “as available” basis. We may modify, suspend, or discontinue features, and we may perform maintenance that causes downtime.

Trademarks

REALTOR® is a registered collective membership mark owned by the National Association of REALTORS® (NAR). WebMax Realtors and WebMax Labs LLC are independent and are not affiliated with, endorsed by, sponsored by, or otherwise connected to the National Association of REALTORS® or any of its member boards or affiliated associations. We use the words “realtor” and “realtors” in their ordinary, descriptive sense to refer to real estate agents generally; that use does not indicate that any particular agent is a member of NAR. Other product and company names referenced on the platform may be trademarks of their respective owners.

Disclaimers

To the fullest extent permitted by law, WebMax disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, WebMax will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

Indemnification

You agree to indemnify and hold WebMax harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the service, or your violation of these Terms or applicable law.

Termination

You may stop using the service and cancel at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that harms others or us. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top and, where appropriate, provide additional notice. Continued use of the service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction.
